Special Needs or Supplemental Needs Trusts
If you have a loved one who is disabled an is or likely will be eligible for "needs based" government benefits such as SSI (Supplemental Social Security Income) or Medi-Cal, you may want to consider either creating a "Special Needs Trust" or making a provision for such a trust in your will or living trust. If you do not make such a provision in your will or trust and your disabled heir received an inheritance from you, your heir will likely become ineligible for such benefits until they either give away or spend down(less than $2,000 at the end of any given month) their inheritance. To avoid this from happening, if you set up a Special Needs Trust, your disabled heir can continue to be qualified for these benefits and receive the benefit of their inheritance.
